What is it?

After a trademark application is filed, the Trademark Registry issues an Examination Report citing grounds for objection - either absolute grounds (the mark is descriptive, generic, or misleading) or relative grounds (a prior similar mark exists). The applicant must file a Reply to the Examination Report within 30 days to defend the application.

Grounds for objection

Absolute grounds (Section 9): Mark is descriptive · Mark is generic · Mark is deceptive · Mark consists exclusively of a geographical name · Mark conflicts with religious sentiments or official symbols. Relative grounds (Section 11): A prior registered or applied-for mark is identical or similar in the same or related class.

Consequences of non-response

If no reply is filed within 30 days of the Examination Report, the application is deemed abandoned. The applicant loses their priority date and must start over with a new application - forfeiting all filing fees paid.

Hearing

If the Examiner is not satisfied with the written reply, a hearing is scheduled before the Trademark Examiner/Registrar. We attend the hearing and present oral arguments to defend the application.
