The Madrid Protocol (Madrid System) is an international trademark registration system administered by the World Intellectual Property Organization (WIPO). An Indian applicant with an existing Indian trademark application or registration can file a single international application through IP India (the Indian Trademark Office) to seek protection in up to 130+ member countries.
How it works
A single international application (MM2 form) is filed with WIPO through the Indian Trademark Office (Office of Origin). WIPO examines the application formalities and transmits it to each designated country. Each country's trademark office examines the application under its national law and grants or refuses protection within 12–18 months.
Cost advantage
Filing one WIPO application to cover multiple countries is significantly cheaper than filing separate national applications in each country. The base fee is calculated in Swiss Francs (CHF) - with country-specific fees for each designated country.
Dependency on home registration
For the first 5 years, the international registration is dependent on the Indian base application/registration. If the Indian registration is cancelled or refused within 5 years, the international registrations are also cancelled - requiring conversion to national applications.
