Adoption in India is governed by two separate legal frameworks: the Hindu Adoption and Maintenance Act, 1956 (HAMA) for Hindus, Buddhists, Jains, and Sikhs; and the Juvenile Justice (Care and Protection of Children) Act, 2015 (JJ Act) through CARA (Central Adoption Resource Authority) for all other citizens and for inter-country adoption. Legal adoption permanently transfers the child's legal status to the adoptive parents.
HAMA adoption vs. CARA adoption
HAMA (Hindu Adoption and Maintenance Act): Direct adoption by Hindu families under personal law. Child is treated as the natural born child of the adoptive parents from the date of adoption. CARA (Central Adoption Resource Authority): Mandatory for non-Hindus and for adoption of orphaned/abandoned/surrendered children. CARA manages the adoption through an online platform (CARINGS) with regulated procedures and waiting lists.
Legal effect of adoption
A legally adopted child has the same rights as a biological child - including inheritance rights, maintenance rights, and the right to use the adoptive parents' surname. The biological parents' rights are extinguished upon adoption. The adoptive parents are legally responsible for the child's welfare in exactly the same way as for a biological child.
Inter-country adoption
Indian citizens living abroad and foreign nationals adopting Indian children must follow CARA's inter-country adoption procedure - involving both Indian regulatory compliance and the adoption law of the receiving country. NOC from CARA is mandatory.
